3. Account Registration

To use our Services, you must create an account. You agree to:

You will maintain proper DNS authentication records
You will not use domains to impersonate others

7. API Usage

When using our APIs, you agree to:

Comply with our API documentation and rate limits
Keep your API keys secure and never share them publicly
Not attempt to reverse engineer or exploit our APIs
Implement proper error handling and retry logic

8. Payment Terms

We reserve the right to modify or discontinue the free tier at any time.

10. Intellectual Property

All content, features, and functionality of our Services are owned by Do.dev, Inc. and are protected by intellectual property laws. You retain ownership of content you submit through our Services but grant us a license to use it for providing the Services.

You may not copy, modify, distribute, or create derivative works from our Services without our express written permission.

11. Data Processing

By using our Services, you authorize us to process email data on your behalf. You represent that you have obtained all necessary consents from your email recipients. Our processing of personal data is governed by our Privacy Policy and, where applicable, our Data Processing Agreement.

12. Service Level

We strive to maintain high availability and reliability. Specific service level commitments, where applicable, are outlined in your plan details or separate service level agreement. We do not guarantee 100% uptime and are not liable for service interruptions.

13. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DO NOT GUARANTEE EMAIL DELIVERY TO ALL RECIPIENTS, AS DELIVERY DEPENDS ON FACTORS OUTSIDE OUR CONTROL.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DO.DEV, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES ARISING FROM YOUR USE OF OUR SERVICES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

15. Indemnification

You agree to indemnify, defend, and hold harmless Do.dev, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

Your use of our Services
Your violation of these Terms
Your violation of any applicable laws or regulations
Content you send through our Services

16. Termination

You may terminate your account at any time through your account settings. Upon termination, your right to use the Services ceases immediately.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts located in Delaware.

Your continued use of our Services after changes take effect constitutes acceptance of the revised Terms.
